What is happening
The European Commission’s 3 July 2026 proposal asks the Council of the EU to set the position that EU representatives would take in the EU-Central America Association CouncilThe joint body that oversees the agreement’s objectives and implementation, examines major issues and adopts decisions or recommendations by mutual agreement between the parties.. The document is an EU proposal: the Association Council’s amendment is an envisaged later act, not an act adopted by this proposal.1
The amendment would supplement Decision No 2/2020. That decision already contains Explanatory NotesGuidance agreed for the interpretation, application and administration of Annex II of the EU-Central America agreement.—guidance on interpretation, application and administration—for Articles 15, 16, 19, 20 and 30 of Annex II, the agreement section to which the guidance applies. The new notes would cover Articles 19, 22 and 27, complementing rather than replacing the 2020 notes. They would address three areas: invoice declarations; corrections to an invoice declaration after exportation; and slight discrepancies and obvious formal errors in proof-of-origin paperwork when those defects do not invalidate the declaration.1
Why it matters
The agreement is between the EU and its member states on one side and Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua and Panama on the other. The Commission says its aim is to increase bilateral trade and strengthen regional integration among the Central American countries. The proposed update is narrower: it concerns guidance for handling origin documentation under that agreement.1
The Commission characterises the envisaged Association Council amendment as legally binding under international law and as having legal effect in the EU. That is why its proposal uses a Council decision to establish the EU position before the joint body acts. The proposal says this implementation measure would not alter the agreement’s institutional framework.1
What happens next
Under the Commission’s draft, the Council decision would make the attached draft amendment the basis of the EU position. EU representatives could agree minor changes without another Council decision. The Association Council, which supervises implementation of the agreement, adopts decisions by mutual agreement between the parties; the Commission says the resulting amendment should be published in the EU’s Official Journal after adoption.1
